Acceptance of terms
By downloading or using Noatly ("the app"), you agree to these Terms of Use. If you do not agree, do not use the app. These terms form a legal agreement between you and the developer of Noatly ("we," "us," or "our").
These terms apply in addition to Apple's standard App Store End User License Agreement, which is also incorporated by reference.
The app
Noatly is a personal journaling app for writing time-locked letters to yourself. Letters are encrypted on your device and cannot be read before their unlock date. The app works entirely offline — there is no Noatly account, server, or cloud storage.
We reserve the right to update, modify, or discontinue any part of the app at any time. We will communicate material changes through the app or App Store release notes where practical.
Your content
Everything you write in Noatly belongs to you. We do not access, read, process, or claim any rights over the content of your letters. Your data never leaves your device and is not transmitted to any Noatly server.
Because your letters are encrypted locally, we have no ability to recover or restore them on your behalf. You are solely responsible for maintaining backups of your device if you wish to preserve your content.
Data loss
Important: Noatly is offline-only. If you delete the app, lose your device, or reset it without a backup, your letters are permanently lost. There is no way for us to recover them.
We strongly recommend keeping iCloud or local iTunes/Finder backups enabled to protect against accidental data loss. The offline-first design is intentional and central to our privacy model, but it means you bear responsibility for device backups.
We are not liable for any loss of content resulting from device failure, accidental deletion, app removal, or any other cause. See Disclaimer and Limitation of Liability below.
Prohibited uses
You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code of the app
- Use the app in any way that violates applicable laws or regulations
- Attempt to bypass the letter lock mechanism or tamper with encrypted data
- Resell, sublicense, or distribute the app outside of normal App Store channels
- Use the app to store or transmit unlawful, harmful, or objectionable content
Disclaimer of warranties
Noatly is provided "as is" and "as available" without warranty of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties including but not limited to:
- Merchantability or fitness for a particular purpose
- Uninterrupted or error-free operation
- The accuracy, completeness, or reliability of any content
- That the app will be free from bugs, viruses, or other harmful components
We make no guarantee that your letters will be delivered, preserved, or accessible at any future date. Technology changes, devices fail, and the app may be discontinued.
Limitation of liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of data, loss of content, loss of profits, or loss of goodwill — arising out of or relating to your use of the app, even if we have been advised of the possibility of such damages.
Our total liability to you for any claims arising from these terms or your use of Noatly shall not exceed the amount you paid for the app or any in-app purchase in the twelve months preceding the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages; in those cases, the above limitations apply to the fullest extent permitted by law.
Governing law
These terms are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. Any disputes arising from these terms or your use of the app shall be resolved in a court of competent jurisdiction.
Changes to these terms
We may update these terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Material changes will be communicated through the app or App Store release notes. Continued use of Noatly after changes are posted constitutes your acceptance of the updated terms.
